Pursuant to the Real Estate Settlement Procedure Act (RESPA), a "Qualified Written Request", or QWR, is a written request (other than notice on your payment coupon or other statement supplied by us) regarding the servicing of your loan which includes your name, account number, and the reason(s) you believe your account is in error and/or sufficient detail regarding the information you are requesting. We will provide a written acknowledgment that we have received the inquiry within five business days following the receipt of an inquiry.

CONSUMERS WISHING TO FILE A COMPLAINT REGARDING THE SERVICING OF YOUR MORTGAGE SHOULD COMPLETE AND SEND A COMPLAINT FORM TO THE DEPARTMENT OF SAVINGS AND MORTGAGE LENDING, 2601 North Lamar, Suite 201, Austin, Texas 78705. COMPLAINT FORMS AND INSTRUCTIONS MAY BE DOWNLOADED FROM THE DEPARTMENT’S WEBSITE AT WWW.SML.TEXAS.GOV.

THE DEPARTMENT MAINTAINS A RECOVERY FUND TO MAKE PAYMENTS OF CERTAIN ACTUAL OUT OF POCKET DAMAGES SUSTAINED BY BORROWERS CAUSED BY ACTS OF LICENSED MORTGAGE BANKER RESIDENTIAL MORTGAGE LOAN ORIGINATORS. A WRITTEN APPLICATION FOR REIMBURSEMENT FROM THE RECOVERY FUND MUST BE FILED WITH AND INVESTIGATED BY THE DEPARTMENT PRIOR TO THE PAYMENT OF A CLAIM.
